Terms of Service
Welcome to Submersible. These Terms of Service ("Terms") govern your access to and use of the Submersible website, mobile application, and related services (collectively, the "Service"), operated by Submersible ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service.
2. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use, subject to these Terms. This license does not grant you any right to redistribute, sublicense, sell, modify, or create derivative works of the Service.
3. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to reverse engineer, decompile, or extract source code from the Service.
- Interfere with or disrupt the Service or its servers.
- Use automated means (bots, scrapers) to access the Service without our written permission.
- Impersonate any person or misrepresent your affiliation with any entity.
- Harass, abuse, or harm other users (where multiplayer features are available).
4. Intellectual Property
All content within the Service — including but not limited to game design, artwork, code, text, music, and the "Submersible" name and logo — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any of this content without our express written permission.
5. Purchases and Payments
The Service may offer optional in-app purchases or merchandise. All purchases are processed through Apple's App Store or our designated third-party providers and are subject to their terms. Purchases are generally non-refundable except as required by law or as offered by the platform handling the transaction.
6. Email Communications
If you join our waitlist or otherwise provide your email, you consent to receive communications related to the Service. You may unsubscribe at any time using the link provided in our emails.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.
9. Indemnification
You agree to defend, indemnify, and hold harmless Submersible and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service immediately ceases.
11. Governing Law
These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict of laws rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Connecticut.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date and, where appropriate, by email. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
